Effective date: October 21, 2026

Evidence Health LLC · Ohio, United States · support@evidencehealth.app

The Services are not medical advice and are not for emergencies. They help you organize and communicate information. They do not diagnose, prescribe, determine medication doses, or tell you to start, stop, increase, decrease, or hold a medication. Always follow instructions provided by your qualified healthcare professionals. Do not change a medication or treatment plan based solely on information from the Services. In an emergency, call 911 or your local emergency number.

1. Agreement and who we are

These Terms of Use (“Terms”) are an agreement between you and Evidence Health LLC (“Evidence Health,” “we,” “us,” or “our”), an Ohio limited liability company. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. The Services

“Services” means Evidence Health websites, mobile and web applications, and related services that link to these Terms, including Warfarin Companion and other Evidence Health products as they become available. Some products are health-related and some are not. For example, Dad Duty is a household organization product and is not a medical product.

Additional terms may apply to a specific product or feature. If they conflict with these Terms, the additional terms control for that product or feature.

3. Not medical advice

The Services are tools for organizing and communicating information. They are not a medical device, and Evidence Health is not a healthcare provider. The Services do not:

Always follow instructions provided by your qualified healthcare professionals. Do not change a medication or treatment plan based solely on information from the Services. Educational content, guides, and labels in the Services are general information and are not a substitute for professional medical judgment. No clinician–patient relationship is created by using the Services.

4. Emergencies

Do not use the Services for emergencies or urgent medical needs. Information you enter is not monitored by Evidence Health or by any clinician in real time. If you think you may have a medical emergency, including signs of serious bleeding, call 911 or your local emergency number, or go to the nearest emergency department.

5. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to create an account. If you use the Services to organize information for another person, such as a parent, spouse, or child in your care, you represent that you have that person’s permission or the legal authority to do so.

6. Accounts

You agree to provide accurate account information and to keep it current. You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly at support@evidencehealth.app if you believe your account has been accessed without permission.

7. Information you enter

You are responsible for the information you enter, including its accuracy and completeness. The Services organize and display what you enter; they do not verify it. Summaries and reminders depend on the information you provide and may be incomplete if entries are missing, delayed, or inaccurate.

8. Clinician instructions you record

The Services may let you record instructions you receive from your healthcare professionals, such as a medication schedule, a target range, or the date of your next test. These records are your own notes. Evidence Health does not review, validate, or update them. If a recorded instruction conflicts with what your healthcare professional currently tells you, follow your healthcare professional, and update or confirm your records with them.

9. Caregiver features

Where available, caregiver features let you invite another person to view or help manage information. You choose whom to invite and what access to grant, and you can revoke access at any time. If you are a caregiver, you agree to use access only to support the person who granted it, to respect their privacy, and not to share their information beyond what they authorize. Being a caregiver in the Services does not, by itself, give you legal authority to make healthcare decisions for another person.

10. Reminders and notifications

Reminders and notifications are a convenience. They depend on your settings, your device, its operating system, and network conditions, and they may be delayed or may not be delivered. Do not rely on the Services as your only way to remember medications, tests, or appointments.

11. Visit Prep, summaries, and PDFs

Visit Prep summaries, reviews, and PDFs are generated from the information you enter. They are patient-reported organizational tools. They are not medical records, clinical assessments, or dosing recommendations. Review a summary before you share it. When you share a summary, you are responsible for choosing the recipient, and the recipient’s use of it is outside our control.

12. Subscriptions

Some features may require a paid subscription. Prices, billing periods, and terms are shown before you purchase.

We may change subscription prices or features. If a change affects an active subscription, we or the store will notify you in advance as required, and the change will apply at your next renewal.

13. Trials and promotions

We may offer free trials, promotional codes, or other offers. Each offer is subject to the terms shown when it is presented. Unless you cancel before a free trial ends, it may convert to a paid subscription where the offer says so. We may limit eligibility, including to one trial per person, and may modify or end offers as permitted by law.

14. Acceptable use

You agree not to:

15. Our intellectual property

The Services, including software, design, text, graphics, logos, and product names, are owned by Evidence Health or its licensors and are protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial purposes. All rights not expressly granted are reserved.

16. Your content

You keep ownership of the information and content you enter (“Your Content”). You grant Evidence Health a limited license to host, store, process, display, and transmit Your Content only as needed to provide, secure, and support the Services for you and the people you choose to share with, and as described in our Privacy Policy. If you send us feedback or suggestions, we may use them without obligation to you.

17. Privacy

Our Privacy Policy explains how we collect, use, and share information, and it is incorporated into these Terms by reference.

18. Third-party services

The Services may rely on or link to third-party services, such as app stores, sign-in providers, and websites. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and policies.

19. Availability and changes to the Services

We work to keep the Services available, but they may be interrupted for maintenance, updates, or reasons beyond our control. We may add, change, or remove features, or discontinue a product. If we discontinue a product you use, we will try to give reasonable notice and an opportunity to export your information where feasible.

20. Beta and pre-release features

We may offer beta, preview, or pre-release products or features. They are provided for evaluation, may contain errors, may change or be discontinued, and may have limited support. Use them with appropriate caution and keep your own records of important information.

21. Suspension and termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services or other users. Where appropriate, we will give notice and an opportunity to export your information. Sections that by their nature should survive termination will survive, including Sections 3, 4, 15, 16, and 22 through 27.

22. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. EVIDENCE HEALTH DOES NOT WARRANT THAT REMINDERS WILL BE DELIVERED, THAT SUMMARIES WILL BE COMPLETE, OR THAT THE SERVICES WILL MEET YOUR MEDICAL OR OTHER NEEDS. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

23. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVIDENCE HEALTH AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, INCLUDING ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO EVIDENCE HEALTH FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). These limits apply to any theory of liability and even if we were advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Evidence Health and its members, managers, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Services, or your violation of another person’s rights.

25. Governing law and venue

These Terms are governed by the laws of the State of Ohio and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to any rights you have under applicable consumer protection law, you and Evidence Health agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Ohio, and you consent to their personal jurisdiction.

26. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. If we make material changes, we will provide notice through the Services or by email before they take effect. Continuing to use the Services after changes take effect means you accept the updated Terms.

27. Entire agreement and general terms

These Terms, together with our Privacy Policy and any product-specific terms, are the entire agreement between you and Evidence Health about the Services and replace any prior agreements on that subject. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms do not create any third-party beneficiary rights, except that where you obtained an app through Apple’s App Store, Apple and its subsidiaries may be third-party beneficiaries to the extent required by Apple’s terms.
